Amtrak Train Accident
On December 18, 2017, an Amtrak train from Seattle to Portland, derailed near Tacoma, Washington on an overpass that crossed I-5. Preliminary reports show that the train was exceeding the recommended speed limit by 50 mph and did not have Positive Train Control (PTC) in use. PTC technology can prevent trains from exceeding the speed limit and may have prevented this train derailment.
Maxwell Graham Law Is Here To Help
If you or a loved one, was involved in this Amtrak Train derailment, it is important to obtain good legal representation as soon as possible. We are experienced attorneys with many years of experience in complex litigation, wrongful death and serious injury cases. We will work to obtain the best possible result so that those who are injured and their families can concentrate on healing.
Unfortunately, a 1997 law limits the amount of money Amtrak will have to pay on all of the claims from this derailment to $200,000,000. What this means for people injured or killed is that a Federal Judge will determine the number of claims and the amount of recovery each individual person will receive, subject to the $200M cap. Having a skilled legal team on your side who can fight for you and your family is essential.
We are saddened by the news that the train was exceeding the recommended speed limit by up to 50 mph. Tragically, early reports show that a the train was not using technology called Positive Train Control (PTC) which can prevent derailments caused by excess speed. PTC is mandated by Congress but not until the end of 2018. This investigation is still in its early stages and it is too early to speculate on why the train was exceeding the recommended speed. None of this makes up for the devastating loss of health and life that this derailment caused.
Our hearts go out to everyone affected by this train disaster as well as to the first responders and medical personnel who are working around the clock to treat the injured.
